General terms and conditions of business

Generally

1.       These General Terms and Conditions (GTC) apply to the processing of all orders from private customers at www.kiafa.ch and regulate the rights and obligations between the www.kiafa.ch sales platform and its customers. Offer and prices

2.       The prices published on www.kiafa.ch at the time of order apply. Availability, price, and product range changes are expressly reserved. All offers and prices on the website are non-binding and without guarantee. Errors or changes to goods and prices are reserved.

Payment methods and Payments

3.       Unless otherwise confirmed in writing, the payment methods listed on www.kiafa.ch apply. For consumers, we retain title to the purchased item until the invoice amount has been paid in full.

4.       The invoice is payable upon order or delivery. For customers unknown to us, or in cases of negative payment history, we reserve the right to request advance payment by payment slip, e-banking, or cash upon delivery. For advance payment, we reserve the goods for five days. If payment is not received, the reservation expires.

Conclusion of contract

5.       The buyer undertakes to place the order in accordance with the terms and conditions stated on the website. Any errors in an order must be reported immediately to info@kiafa.ch.

Delivery conditions

6.       Unless otherwise confirmed in writing, the shipping costs listed on www.kiafa.ch apply. Delivery generally takes place within two to five business days within Switzerland and is sent to the address provided by the customer. If the ordered product is not available from stock, the customer will be contacted. The shipping partner is Swiss Post. www.kiafa.ch sells its products exclusively in Switzerland. Delivery abroad is not possible.

7.       In the event of inability to deliver due to force majeure, we guarantee to refund the price you paid without any further obligation.

Customer review

8.       The customer must inspect deliveries received from www.kiafa.ch within 5 calendar days of delivery or collection and report any visible defects or incomplete deliveries in writing or by email to info@kiafa.ch. After this period, deliveries from www.kiafa.ch are deemed to have been fully approved by the customer.

Disclaimer

9.       The customer acknowledges that www.kiafa.ch only conducts random incoming inspections of the products delivered by the supplier. By placing your order, you confirm that www.kiafa.ch cannot be held liable for any complaints or complications.

10.    www.kiafa.ch is only liable for direct damage to the delivered products and only if the customer can prove that this was caused by gross negligence on the part of www.kiafa.ch . Liability is limited to the price of the respective delivery. In particular, the customer is not entitled to compensation for damages not caused by the product itself, such as production downtime, loss of data, loss of orders or lost profits, and other indirect or direct consequential damages. The contractual and non-contractual liability of www.kiafa.ch is fully excluded to the extent permitted by law.

Return / Right of withdrawal

11.    In principle, there is no right of return for products of any kind.

12.    Exceptions only arise with the written consent of www.kiafa.ch, e.g. in the case of hidden defects in the delivered goods.

13.    The right of withdrawal arises in the event of a delivery delay of more than four weeks without prior notification to the customer. In this case, the buyer has the right to withdraw from the purchase contract. The goods must be reported in writing to info@kiafa.ch immediately upon discovery of the defect and then returned. The customer shall bear the return shipping costs, unless otherwise confirmed in writing by www.kiafa.ch .

14.    www.kiafa.ch reserves the right to cancel orders at any time without giving reasons and/or to only partially deliver them. In the event of a partial or complete cancellation of the order, the customer shall only pay for the partial service actually provided by www.kiafa.ch .

15.    www.kiafa.ch is under no circumstances obligated to procure products.

Alternative dispute resolution according to Art. 14 para. 1 ODR-VO and Section 36 VSBG:

16.    The European Commission provides a platform for online dispute resolution (ODR), which can be found at https://ec.europa.eu/consumers/odr . www.kiafa.ch is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Data protection

17.    All data will be treated confidentially and will not be shared with third parties. The customer agrees that his or her personal data will be stored and processed electronically within the scope of the business relationship. Please note that data collected within the meaning of this provision will be collected and processed exclusively for the purposes of providing services, such as order processing and accounting. Data transmission is encrypted. No liability can be assumed for the security of data transmitted over the Internet.

Severability clause and validity of the General Terms and Conditions

19.    By placing an order, the customer accepts the General Terms and Conditions of www.kiafa.ch. Should any provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be immediately replaced by the relevant statutory provision. Verbal agreements require written confirmation to be valid.

20.    www.kiafa.ch reserves the express right to adapt these General Terms and Conditions to the circumstances at any time and to apply them immediately
